Jefferson County Circuit Court Issues Decision in WMC v. DNR

The Jefferson County Circuit Court issued a decision in WMC v. DNR, which concerns the scope of the DNR’s authority under Wisconsin’s wastewater discharge law. The court concluded that DNR has statutory authority to enter a business’s private property to sample for PFAS compounds if the business has a WPDES permit. However, the court further concluded that the DNR may not bring enforcement actions regarding PFAS compounds until the DNR adopts a regulation that identifies PFAS compounds as toxic substances.
