Court Delays Decision in WMC v. DNR to April 2022

The Waukesha County Circuit Court announced that it will postpone the WMC v. DNR case decision until April 7, 2022. In this case, WMC argues that the Department of Natural Resources cannot regulate “emerging contaminants,” including PFAS chemicals, under Wisconsin’s Spills Law without first going through the formal rulemaking process. This case could have a big impact on businesses’ potential liability for cleaning up PFAS chemicals on their property.
