Wisconsin Supreme Court Hears Oral Arguments For Two Important Voting Cases

The Wisconsin Supreme Court concluded the month September with oral arguments in two potentially important election cases: Timothy Zignego v. Wisconsin Elections Commission (19AP2397) and Mark Jefferson v. Dane County (20AP557-OA).

Timothy Zignego v. Wisconsin Elections Commission (19AP2397) involves a challenge to the Wisconsin Election Commission’s alleged non-compliance with Wis. Stat. § 6.50(3), which requires a change in a voters’ status from “eligible” to “ineligible” upon a change of residency. If the court finds noncompliance occurred, the decision could purge about 130,000 people from voter rolls. You can listen to a recap of the oral arguments here.

The second case, Mark Jefferson v. Dane County (20AP557-OA), is an original action brought by the Republican Party challenging a statement made by the Dane County Clerk that voters could claim they were “indefinitely confined” due to the COVID-19 pandemic and so evade the state’s photo ID requirement to vote. The Wisconsin Supreme Court is not expected to issue a decision in either case before the November election.
