The Wisconsin Supreme Court heard oral arguments in Gregory M. Backus v. Waukesha County. The main issue before the Supreme Court is how to determine the amount of compensation that the government owes a landowner when it imposes a temporary easement on private property. The WMC Litigation Center previously filed an amicus brief in the Supreme Court on WMC’s behalf, explaining why “rental value” is sometimes an inadequate way to measure compensation owed for a temporary easement.
