The Wisconsin Court of Appeals (District I) ruled Tuesday that the the Friends of the Black River Forest alleged sufficient facts to satisfy a standing inquiry and that the Department of Natural Resources Board approval of a land exchange was a “decision” subject to judicial review under ch. 227

On September 10th, the Wisconsin Department of Natural Resources released the survey results of Wisconsin firefighters’ use of firefighting foams contains PFAS, otherwise known as or per-and polyfluoroalkyl substances.

Here we go again. Another Wisconsin agency head—again directed by a high-level politician—commits to follow the science to fact-based mandates. Whenever you hear that, brace yourself. You are about to be skewered by the administrative state, the sole proprietors of the “scientific” black box they’ll use to regulate or terminate your business.

Ten environmental groups, including Clean Wisconsin and Midwest Environmental Advocates, submitted a letter to the Natural Resources Board requesting them to approve DNR’s emergency rule concerning PFAS contamination “without changes at the September 22nd meeting.”

“This time, instead of DNR presentations, this meeting will be an opportunity for stakeholders to present.”

GLLF submitted comments on DNR’s proposed guidance for high capacity well application review process, arguing it ignored the ongoing litigation in Clean Wisconsin v. DNR on this very issue, overstepped the boundaries of DNR’s explicit authority, and at minimum needed to go through rulemaking.
