Judge Extends Injunction in WMC Lawsuit to Protect Name of Businesses with COVID-19 Positive Employees from Being Publicly Released.

On October 7th, a Waukesha County Judge extended an injunction that prevented the Wisconsin DHS from publicly releasing names of businesses that have had COVID-19 positive employees. The original injunction was a result of a Wisconsin Manufacturers and Commerce lawsuit to block the release of the names. DHS says that they want to release the names in compliance with open records request law as they have received open records requests about which businesses have had positive employees. WMC, on the other hand, argues that this would violate state law that protects medical records from being publicly released, as well as violate the 14th amendment right to privacy. A hearing for the case has been set for November 30th.
