GLLF Files Reply Brief In Support of Legislative Intervention

On July 9, the Great Lakes Legal Foundation filed a reply brief in support of the legislature’s motion to intervene in Clean Wisconsin v. DNR. The case involves 2011 Wis. Act 21, which limited agency authority to explicit grants from the Wisconsin Legislature.

More specifically, DNR issued nine high capacity well permits challenged in this case by Clean Wisconsin. Though originally DNR upheld the legitimacy of the permits under Act 21, it switched sides before the Wisconsin Supreme Court, leaving GLLF the only advocate for the farmers whose permits Clean Wisconsin challenged.

The Legislature moved to join GLLF as intervenors on April 25th.
